These Terms of Service ("Terms") constitute a binding legal agreement between you ("User," "you," or "your") and Gignix, Inc. ("Gignix," "we," "our," or "us") governing your access to and use of the Gignix AI interview preparation software platform. By creating an account or utilizing any platform feature, you agree to be bound by these Terms in full.
1. Acceptance of Terms
By accessing the Gignix platform, creating an account, or purchasing any software tier access, you confirm that you have read, understood, and agree to these Terms. If you do not agree to any provision of these Terms, you must immediately cease all access and use of the platform.
These Terms apply uniformly to all individuals accessing the platform features, including free evaluation access paths, premium package subscribers, or promotional trial accounts.
2. Service Description and Purpose
Gignix is a software-as-a-service (SaaS) platform that leverages AI models to provide interactive, self-serve interview preparation modules and detailed feedback reports to help job seekers improve their communication and interview readiness.
The services provided are strictly for professional self-improvement purposes. Gignix does not represent or guarantee employment outcomes, job offers, or placement success of any kind. All employment decisions remain the exclusive responsibility of users and their respective prospective employers.
3. Authorized Use and Account Security
Access to the Gignix platform is granted subject to the following structural scope and restrictions:
3.1 Personal License
Your account is licensed exclusively for your individual use. Credentials, software features, and saved historical records may not be shared, rented, or utilized to provide services on behalf of any person or entity other than the registered account holder.
3.2 Prohibited Exploitations
Automated interaction with our system—including web scraping, automated bot inputs, systematic extraction of feedback patterns, or unauthorized API interventions—is strictly prohibited and constitutes a material breach resulting in immediate profile termination.
4. Platform Access and Performance
To utilize our AI-driven interview preparation dashboards, users are responsible for ensuring their own hardware and network parameters meet necessary operational guidelines:
- Input Assets: Audio processing features require a clear, functional hardware microphone and a stable internet connection. Gignix is not responsible for incomplete transcriptions, formatting drops, or feedback delays stemming from local network failures or browser hardware limitations.
- Concurrent Protection: Accounts are constrained to a single active session instance. Coordinated multi-device logins using a single profile may result in transactional data drops or profile conflicts.
5. Intellectual Property Rights
5.1 Gignix System Ownership
The Gignix software, user interfaces, corporate brand elements, analytical evaluation logic, custom graphics, and vector code structures are the exclusive intellectual property of Gignix, Inc. No proprietary rights, trade secrets, or structural design permissions are transferred through your regular platform usage.
5.2 User Ownership of Personal Feedback Reports
You retain full intellectual property ownership over all personalized career summary documents and performance feedback reports compiled from your active platform exercises. Gignix grants you an irrevocable, perpetual, non-exclusive right to download, clone, display, and share your generated reports for any personal or professional career-advancement purpose.
6. Subscription Billing and Merchant Processing
Platform transactions and membership fees are governed by the following operational financial terms:
- Billing Cycles: Premium subscription models are processed on a recurring monthly cycle. Recurring fees are captured automatically on the monthly anniversary matching your original upgrade timeline.
- Currency and Inclusions: Pricing metrics are listed and processed in United States Dollars (USD). Users remain responsible for any localized sales taxes or VAT percentages applicable under their residential jurisdiction.
- Merchant Architecture: Payment processing transactions are routed entirely through our Merchant of Record billing networks. Gignix never interacts with, writes, or keeps raw banking card numbers, secure security digits, or financial routing data in our storage databases.
7. System Uptime and Service Exclusions
Gignix deploys reliable cloud hosting infrastructure to preserve operational uptime. However, the software services are rendered on an "AS IS" and "AS AVAILABLE" framework without direct statutory warranties. Scheduled system updates, hosting node reboots, or external cloud latency anomalies may result in brief execution halts. Core compensation or monetary remediation for service variations is limited entirely to the parameters outlined inside our centralized Refund Policy.
8. Liability Limits
To the highest boundaries allowed under applicable corporate laws, the aggregate financial liability of Gignix, Inc. for any contract disputes, technical faults, or service claims shall never exceed the absolute monetary sum paid by you to Gignix during the specific twelve-month timeframe immediately preceding the dispute filing date.
9. Modifications to the Service and Terms
We reserve the right to deploy feature enhancements, adjust plan access variables, or update these Terms to remain compliant with transaction processor frameworks. Registered users will receive email updates at least 14 days prior to any material structural changes taking effect. Your continued platform use following the conclusion of that notice cycle indicates your acceptance of the updated document.
